What is a section 18.001 counteraffidavit?
In a Texas personal injury case, section 18.001 of the Civil Practice and Remedies Code allows a party to prove by affidavit that medical charges were reasonable and necessary. A counteraffidavit is the sworn response from a party who disputes those charges. Ours addresses reasonableness and coding only, itemizes each controverted charge against the provider's initial affidavit, gives notice of the basis in plain terms, and is sworn before a notary by Suren Khachatryan, a Certified Professional Coder.
Does $850 cover all the provider bills?
Yes. $850 is one flat fee for all the provider bills in the case, however many providers there are. Most services price each provider separately. We charge once for the whole case.
What does first counteraffidavit mean?
The first counteraffidavit we prepare for a law firm is $450. That price applies once per firm. Every counteraffidavit after that is $850 flat for all provider bills in the case.
Will Suren testify?
Yes. Suren, who signs your counteraffidavit, is available for deposition and for trial testimony on it. He has not yet been deposed or testified at trial, and his CV says so. Tell us at the start of the case if testimony is likely, so the counteraffidavit is written knowing it will be defended out loud rather than only read. Testimony is quoted separately.
